UK Spouse Visa: A Complete Guide

The UK Spouse Visa is designed for the married partners of qualifying individuals to join or remain with their spouse in the UK. This route is available to partners of British or Irish citizens, persons settled in the UK, those with pre-settled status, holders of a Turkish Businessperson or Worker visa, and individuals with refugee status or humanitarian protection. You may also apply if your sponsoring partner is currently outside the UK but intends to return with you.

Pathway to Settlement

This visa category offers a clear route to permanent residence. After completing five years in the UK on a Spouse Visa, you may be eligible to apply for indefinite leave to remain (ILR), also known as settlement.

Core Qualification Criteria

To be eligible for a UK Spouse Visa, you and your partner must meet a comprehensive set of requirements. You must demonstrate that:

  • Your sponsoring partner holds one of the qualifying immigration statuses (e.g., British/Irish citizen, settled status, pre-settled status, etc.).

  • Both you and your partner are aged 18 or over.

  • You are not within a prohibited degree of relationship (as defined by UK law).

  • You have met each other in person.

  • You are legally married in a ceremony recognised by UK law.

  • Your relationship is genuine and subsisting.

  • You intend to live together permanently in the UK.

  • Any previous marriages or civil partnerships have been legally and permanently dissolved.

  • You meet the minimum financial requirement.

  • You have adequate accommodation in the UK.

  • You can demonstrate English language proficiency to the required level.

Status of the Sponsoring Partner

Your UK-based partner must have one of the following immigration statuses:

  • Be a British or Irish citizen currently in the UK, or one who is returning to the UK with you.

  • Hold indefinite leave to remain, settled status, or permanent residence in the UK.

  • Hold pre-settled status under Appendix EU of the Immigration Rules.

  • Hold limited leave to remain as a Turkish Businessperson or Worker under Appendix ECAA.

  • Hold refugee leave or humanitarian protection status.

Proving Your Relationship

You will need to provide extensive evidence to satisfy the Home Office of the following relationship criteria:

  • Legal Marriage: Your marriage is legally valid. Marriages in the UK must be monogamous and conducted by an authorised person, with both parties meeting the minimum age requirements. Overseas marriages will be recognised if they comply with the law of the country where they took place and there are no legal impediments from either partner's country of domicile.

  • Genuine and Subsisting Relationship: You must prove your relationship is real and ongoing. The Home Office will consider factors such as evidence of cohabitation, financial interdependence, and shared future plans. You must demonstrate a clear commitment to living together in the UK. Any absences from the UK should be limited and justified.

  • Previous Relationships: You must provide evidence that any previous marriage or civil partnership has been legally ended (e.g., with a final divorce decree or dissolution certificate). If a previous marriage has not been legally dissolved, you may wish to explore the Unmarried Partner Visa route.

Meeting the Financial Requirement

You must show that you and your dependants can be supported in the UK without recourse to public funds. The minimum gross annual income required is £29,000.

Various sources of income can be combined to meet this threshold, including:

  • Employment income (from the sponsor and/or the applicant).

  • Non-employment income (e.g., from property rental or investments).

  • Cash savings.

  • Pensions.

It is crucial to note that the financial requirement must be met at the initial application stage, at the extension stage, and again when applying for settlement.

Accommodation and English Language Requirements

  • Adequate Accommodation: You must provide evidence of suitable accommodation in the UK for you, your partner, and any dependants. The accommodation must be owned or legally occupied by you or your partner and must not be overcrowded.

  • English Language Proficiency: You must demonstrate a specified level of English ability. For the initial visa, the requirement is CEFR Level A1 in speaking and listening. For further leave to remain (extension), this increases to CEFR Level A2. Exemptions may apply based on age, a physical or mental disability, or other exceptional circumstances.

Application Fees and Processing Times

  • Fees: The application fee is £1,846 for applications made from outside the UK, and £1,048 for applications made within the UK. Additional charges apply for priority or super-priority processing services.

  • Processing Times: Standard processing times vary considerably. Applications from outside the UK can take up to 24 weeks. In-country applications generally take up to 8 weeks. Priority services offer significantly faster decisions for an additional fee.

Duration, Extension, and Switching

  • Initial Grant: A Spouse Visa is usually granted for a period of 30 months (or 33 months if applying from outside the UK) to allow for entry.

  • Extension: You must apply for an extension before your current leave expires.

  • Switching to a Spouse Visa: You may be able to switch to this route from within the UK, provided you do not currently hold a Visitor visa or have leave granted for 6 months or less. Exceptions apply for certain categories, such as those on a Fiancée visa.

Rights and Settlement (ILR)

  • Work Rights: Spouse Visa holders have full rights to work in the UK without restriction.

  • Indefinite Leave to Remain (ILR): After completing 5 years in the UK on this route (including time on a Fiancée or Partner visa), you can apply for ILR. To qualify, you must continue to meet all the ongoing requirements, including the financial, accommodation, and relationship tests, as well as demonstrating a higher level of English proficiency (CEFR Level B1).
